Sportal Horse Racing Dream Team™ - Terms & Conditions

1. For the purpose of this promotion the following definitions apply:

"Promoter" means Vapormedia Pty Ltd, of 107/425 Docklands Drive, Docklands VIC 3008, in association with Sportal Australia Pty Ltd, of 120 Harbour Esplanade, Docklands VIC 3008;

"Promotion" means the Sportal Horse Racing Dream Team™, conducted during the course of 11 race meetings of the 2011 Spring Racing Carnival;

"Race Meeting" means a singular race meeting during the 2011 Spring Racing Carnival;

"Race Meetings" means all race meetings during the 2011 Spring Racing Carnival;

"Promotion Period" means the period commencing at 12pm Australian Eastern Savings Time ("AEST") on 26.09.11 and closing on 11.59pm Australian Eastern Standard Time ("AEST") on 13.11.11;

"Website" means racing.virtualsports.com.au or horseracingdreamteam.sportal.com.au.

2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions and the Website Terms of Use. In the event of any inconsistency, these Terms and Conditions shall prevail. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

3. Entry is open to Australian residents and non-Australian residents, except where prohibited. Notwithstanding the foregoing, only Australian and New Zealand residents are eligible to win any prizes, excluding the directors, managers and employees (and their immediate family) of the Promoter and agencies associated with this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. To enter, the entrant must firstly register by completing the online registration process at the Website during the Promotion Period. Entrants will be required to (a) choose a nickname/alias to identify their entry; and (b) subject to any "Salary Cap Limitations" as detailed on the Website, submit a complete Horse Racing stable of 12 horses ("Chosen Stable") comprising the following categories:

4 x 3 year olds
8 x 4 year Olds +

5. Only one registration per entrant (and per email address) will be accepted. If invited to enter a particular league, entrants may enter their details to join that league during the registration process. Alternatively they can create up to five private or public leagues and invite others to join. If they do not select a league, entrants will automatically be entered into a public league. Subject to an entrant's eligibility to win a prize, an entrant's chances of winning a prize will not be affected by whether they join a public league or private league. Rankings as displayed on the Website include the rankings of all entrants, and not only the rankings of entrants that are eligible to win a prize, and therefore should not be relied upon as indication of who will a prize.

6. During registration entrants may refer the promotion to their friends via email using the refer-a-friend facility on the Website. If an entrant refers a friend, they warrant that they have obtained their friend's consent to do so prior to sending the email. The entrant indemnifies the Promoter against any claims by any third party for the entrant's failure to do so.

7. Entrants may replace horses in their Chosen Stable via the "Trade Page" on the Website, in accordance with any directions. Entrants may make a maximum of 18 horse trades for the competition, with a maximum of 3 trades in any given Trade Period. Horse trades must take place prior to the commencement of a particular Race Meeting to be eligible to be selected for that Race Meeting, and are subject to any Salary Cap Limitations as detailed on the Website. Horses traded during the season do not get their aggregate points added or subtracted to the entrant's total. For sake of clarity, if the horse is removed from, or added to the Chosen Stable, only the points earned by that horse for that entrant, prior to their removal or after their addition from the Chosen Stable, in accordance with these Terms and Conditions, count towards the entrant's total.

8. After registration, entrants may enter all remaining Race Meetings that have not been locked out or completed. Subject to clause 9, to enter a particular Race Meeting, the entrant must prior to the lockout period for that Race Meeting (as notified on the Website), submit their "Race Meeting Stable" comprising of 12 "Starting Horses" from their Chosen Stable in the positions as available at the web site.

Entrants may select a "Stable Captain" who will score double points.

9. If, after participating in a Race Meeting, an entrant does not amend their Race Meeting Stable, their Race Meeting Stable from the previous Race Meeting as selected by the entrant will be used, regardless of whether or not those horses will be running in the coming Race Meeting.

10. Entrants will score points based upon the performance of their selected horses in their Race Meeting Stable for the particular Race Meeting. Points will be awarded for each performance statistic attributed to that horse during the Race Meeting as follows:



11. The Promoter"s decisions in relation to all aspects of this Promotion is final and no correspondence will entered into, including decisions in relation to the number of points that entrant may have earned.

12. Rankings of entrants from the last Race Meeting completed will appear on the Website. Rankings on the Website may not give a true indication of the eventual winner of a prize.

13. The prize selection process will take place at 12pm AEST on 14.11.11 at Vapormedia Pty Ltd, 107/425 Docklands Drive, Docklands VIC 3008. The entrant, from those entrants who are eligible to win a prize in accordance with clause 3, with the highest point score at the conclusion of all Race Meetings will win the prize of a Sportal Prize Pack, valued at a maximum of $100. If there are more than two entrants with the equal highest number of points, the winner will be the person who registered on the Website first in time. The winner will be notified by mail, email and phone and their name will be published on the Website on 14.11.11.

14. If a prize is not claimed by 12:00 noon 14.02.12, the entrant who had the second highest score will receive that prize. If a prize remains unclaimed, the draw to award any unclaimed prize will take place at the same time and place as the original draw on 14.02.12. The winner, if any, will be contacted by mail, email and phone and published on the website on 14.02.12.

15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who in the opinion of the Promoter tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

16. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid. Entries containing inappropriate, offensive, derogatory or defamatory content, as determined by the Promoter will deemed invalid and may be removed from display.

17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

18. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

19. Total prize pool value is up to $100.

20. Prize is not transferable or exchangeable and cannot be taken as cash.

21. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any services supplied by the Promoter.

22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

23. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the prize.

25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose and such other purposes as detailed in Promoter's privacy statement at racing.virtualsports.com.au, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter by emailing support@vitualsports.com.au. All entries become the property of the Promoter.
